THE FOLLOWING CONTRACT, MADE ON ______________, 20___ BETWEEN MAGICAL MUSIC EXPRESS AND THE UNDERSIGNED PURCHASER OF DISC JOCKEY SERVICES ('PURCHASER') IN ACCCORDANCE WITH THE DETAILS SUPPLIED BY PURCHASER.  THE PARTIES HERETO AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS CONTRACT.

THIS IS YOUR INVOICE.  PLEASE MAKE CHECKS PAYABLE TO MAGICAL MUSIC EXPRESS.

A reserved date and time cannot be changed solely by Magical Music Express once a deposit down payment has been made and thus the deposit down payment of 50% is your guarantee for full services identified in this contract to be rendered.  Magical Music Express can at its discretion book that date and/or time to another party who has placed a deposit first for that date and time.  If payment is made by check, then the date the check clears is the date we acknowledge acceptance of a client's down payment and from that date, you are guaranteed that spot on our calendar.  The above named person (client) and Magical Music Express may change any item above provided they both jointly agree to the change and a new contract is created with the changes.  Any new contract supersedes all previous contracts and is determined by the signature date at the end of the contract.  Should the client cancel the even prior to the even a refund may be given by Magical Music Express under the following terms. 

Prior to 60 days before the event:        50% of deposit
Prior to 30 days before the event:        25% of deposit
Prior to 14 days before the event:          0% of deposit

Should the client request Magical Music Express and its representative play for more than the contracted time on the day the event occurs, the Purchaser shall render payment for the services at the time of the extension of that entertainment at the negotiated rate.   Any extension must be agreed upon by both the Purchaser and the client and the entertainer from Magical Music Express and Magical Music Express shall be held harmless if any extensions cannot be granted due to other circumstances.

ADDITIONAL TERMS AND CONDITIONS

Purchaser must provide the following: 1.  One 6-foot table in order to place music and equipment.  2.  A standard electrical outlet within 25 feet of table.  3.  Parking facility/area near loading area at no cost to Entertainer.  To guarantee start time, Entertainer must have uninhibited access to the place of event 60 minutes prior to the start time for the purpose of setup.  If event is outdoors, DJ and all equipment must be completely covered. 

Should the client need to shift the location from that agreed upon above, the client must give ample notice to Magical Music Express of the change.  Additional fees may be incurred from the client for the change of venue.  Should the change be within 25 miles of the contract venue, no additional charges will be rendered.  A fee of $50.00 per 25 miles in extended difference will be applied to the original contracted cost to cover fuel and labor expenses for the additional expenses incurred by Magical Music Express.  If Entertainer sets up equipment in the specified location or if it was not specified where to set up and the Entertainer is requested to move the equipment to another location, there will be an additional charge of $75.00. 

The conditions of the place of event will not inhibit the performance, no cause injury to Entertainer.  Purchaser will be responsible for the conduct of all persons such that their conduct will not inhibit the performance, nor cause injury to Entertainer.  Purchaser will be responsible for any loss or damage to any property of Entertainer caused by guests, customers, students, etc.  Entertainer reserves the right to cease performance if these conditions are not maintained during the entire contract time.

If we cannot perform due to an act of God or Nature or due to damage created by the Purchaser, their guest(s) or the Purchaser's chosen facility, Magical Music Express will not be held liable for any time they cannot perform and the full terms of the contract shall apply.  Should Magical Music Express not show for any reason, the client is entitled to a full 100% refund of any funds paid in advance.  In the unlikely event that the equipment would malfunction and time is lost, it would be at the option of the Purchaser to be reimbursed for the portion of time lost or to extend the contract to include that portion. 

If checks are returned for any reason, Entertainer will have the option of requiring payment in full, and an additional fee of $25.00.  

This basic contract covers the music and audio equipment.
