Magical Music Express
Entertainment Contract
THE FOLLOWING DOCUMENT ISA CONTRACT FOR DJ ENTERTAINMENT SERVICES TO BE PROVIDED BY THE ENTERTAINMENT COMPANY, MAGICAL MUSIC EXPRESS. THIS DOCUMENT PROVIDES THE CLIENT AND THEIR GUESTS AS WELL AS MAGICAL MUSIC EXPRESS AND THE ENTERTAINERS THEREOF WITH ALL THE EXPECTATIONS FOR A SUCCESSFUL EVENT.
I, ___Your name in here______ residing at ___Your address in here____, hereby contract the services of Magical Music Express to entertain at an upcoming event on _Your event date_. The contracted time the services will be available are from _1:00__ p.m. to _11:00_ p.m. on the above date at a rate of __75.00__ dollars with 50% or _$375.00_ due to reserve the date and time above and the balance due at the day of the event. Additional time may be booked at a rate of _$75.00_ for first extra hour and a rate of _$50.00_ for each additional hour if approved by both Magical Music Express and the client on the day of the event only. If paying by Credit Card add 6% service charge. This can be done by Paypal online (Call us for details).
The location of the event is at _Where it all happens__in the city of _The city of fun_, Ohio. Magical Music Express requires time in advance of the time listed above for the setup of our equipment. This time will vary based on the amount of the equipment you have contracted for and the facility you are using. A reserved date and time cannot be changed solely by Magical Music Express once a deposit down payment has been made and thus the deposit down payment of 50% is your guarantee for full services identified in this contract to be rendered. Magical Music Express can at it s discretion book that date and/or time to another party who has placed a deposit first for that date and time. If payment is made by check, then the date the check clears is the date we acknowledge acceptance of a client's down payment and from that date, you are guaranteed that spot on our calendar. The above named person (client) and Magical Music Express may change any item above provided they both jointly agree to the change and a new contract is created with the changes. Any new contract supersedes all previous contracts and is determined by the signature date at the end of the contract. Should the client cancel the event prior to the event a refund of the required 50% deposit may be given by Magical Music Express under the following terms.
Prior to 60 days before the event: Refund of 90% of the required deposit
Prior to 30 days before the event: Refund of 50% of the required deposit
Prior to 14 days before the event: Refund of 25% of the required deposit
After 14 days before the event: Refund of 0% of the required deposit
A 100% refund will be given on any deposit amount over the required 50% down payment. Should the client request Magical Music Express and its representative play for more than the contracted time on the day the event occurs, the client will need to render payment for the services at the time of the extension of that entertainment at the rate specified above. Any extension must be agreed upon by both the client and the entertainer from Magical Music Express and Magical Music Express shall be held harmless if any extensions cannot be granted due to other circumstances.
Should the client need to shift the location from that agreed upon above, the client must give ample notice to Magical Music Express of the change. Additional fees may be incurred from the client for the change of venue. Should the change bet within 25 miles of the contract venue, no additional charges will be rendered. A fee of $50.00 per 25 miles in extended difference will be applied to the original contracted cost to cover fuel and labor expenses for the additional expenses incurred by Magical Music Express.
The client will be held responsible for damage/theft of Magical Music Express equipment or damage to DJ company employees caused by crowd members or guests, faulty wiring, or structural issues. A safe place with secure solid flooring must be provided to support the weight of the equipment to assure that it cannot tip over due to environmental conditions such as muddy ground surfaces that are uneven or can give way under the weight of heavy sound system or lighting equipment that weighs less than 150 pounds. The equipment used by Magical Music Express must be set up in a dry location. Should the event be outdoors, a location must be chosen that should inclement weather occur, the equipment must be moved to safe and dry location before damage will occur to that equipment. The client must also provide reasonable security measures to assure the safety of Magical Music Express entertainers and the security of the sound and effects equipment. Magical Music Express will be held harmless for damage to your facilities from the normal use of our equipment. Our equipment will require at least a safe 10 amp electrical circuit with proper grounding that you must provide. Electrical overloads are the responsibility of the client and most circuit breakers for electrical boxes or fuses provide for 15 to 29 amp circuit loads. Heavy duty extension cords that can handle that amperage are acceptable. We will provide surge protected out let strips to operate our equipment.
Magical Music Express by accepting the down payment has agreed to promise to perform at the client's event. Should for some reasons such as acts of God or Nature prevent the execution of this agreement the client is entitled to certain rights under this agreement. If we cannot perform due to damage created by the client, their guest(s) or the client's chosen facility, Magical Music Express will not be held liable for any time they cannot perform and the full terms of the contract shall apply. Should Magical Music Express not show for any reason, the client is entitled to a full 100% refund of any funds paid in advance. We have back-up equipment available, but should the main equipment fail to function, and a repair needs to be done the client is entitled to a refund based on the labor rate when that service is greater than one full half hour and for each full half hour thereafter.
If the repair exceeds the half-hour, the client shall receive a refund for half of the hourly rate.
If the repair exceeds the full hour, the client shall receive a refund for the full hourly rate.
This basic contract covers the music and audio equipment. Magical Music Express makes available at an extra charge other items the client may wish to order. Those items may be dance floor lighting, fog and bubble machines, laser beam generating machines operating in the safe visual spectrum. Karaoke music and equipment, pin spots and mirror balls both plain and color. A separate agreement will be required to contact out for those services with the fees for those services being fully disclosed on that agreement.
